North Carolina Court of Appeals Affirms Summary Judgment For Defendant In Auto vs. Pedestrian Accident
Simpson Law obtained a favorable opinion from the North Carolina Court of Appeals in the recently published opinion of Patterson v. Worley. The plaintiff, a pedestrian who was struck by the defendant’s auto, appealed the trial court's grant of summary judgment in favor of the defendant. Because the plaintiff was unable to show that the defendant was negligent, that her own contributory negligence would not defeat her claim, or that the doctrine of last clear chance would apply, the defendant was entitled to judgment as a matter of law. The Court of Appeals therefore affirmed the order of the trial court granting summary judgment to the defendant.
